Legal Question in Wills and Trusts in New York
my dad died in 2004, and I came across some documents that suggest that he had one or more bank accounts, he has never been married and I am his only child. How do I go about becoming executor or beneficiary of his estate to inquire about these bank accounts? I live in Georgia.

You must petition the Surrogate's Court in the county where your father lived for Letters of Administration. With these Letters, you'll have the legal authority to communicate with the bank(s) about the status of the accounts, and to take possession of the funds. You may contact my office at 21-401-2990 for a brief complimentary consultation.
Before you run to the Surrogate's Court and spend money, conduct a search to determine if the unclaimed funds escheated to New York State. The website is http://www.osc.state.ny.us/ouf/index.htm.
If there are unclaimed funds you may be able to find the amount of the funds by contacting the New York State Comptroller. The office may or may not give you the answer. If the funds held are significant, you would then have to file a petition as suggested by Mr. Park.
