Legal Question in Wills and Trusts in New York
My dad past away, but didnt leave a will. we have a lawyer getting things squared away. Can he add his percentage to the life insurance money?

It depends on the language in the retainer agreement and actual work performed by the attorney. If the language in the agreement calls for a percentage of money comming into the estate, then the answer to your question would be no since life insurance in inherited outside an estate. If the language in the agreement calls for all money received by all beneficiaries, then the answer maybe yes. However, it would be yes only if the legal fee is commenserate with the amount of work performed by the attorney.
