Dad no will step mother now in critcal condition

My dad passed 11/05 step mother took all insurance money now she is not expected to survive a car accident step brother her next of kin ( we were raised by her and father) there are 4 of us from first marriage father could not read or write so no will just things he verbally said to us that she did not follow through with do we have any legal rights to any or is it just going to all go to the step-brother

It depends on whether or not she has a Will. If not, then everything would pass to her son.

I am assuming that your stepmother was the beneficiary of your father's insurance proceeds. If she was not the sole beneficiary, then you may have a claim against her or her estate for a portion of those proceeds.
