Legal Question in Wills and Trusts in New York

Death

My Mother recently passed away. She lived in New York State alone in her apt. She left no will. The Police found her after she died in her sleep and therefore sealed the apt. How do I go about obtaining her belongings to distribute them among the family I am the only son, and dad died years ago.

You would have to file a petition with the Surrogate's Court to be the administrator of the estate. Since you are the only child and the father predeceased, this is a fairly simple process. Once you receive "Letters of Administration", you will be able to properly handle her estate (bank accounts, stocks, bonds, realty, etc.).

I agree with Michael. However, if your mother's estate is very small you may be able to gain access to the apartment by contacting the Public Administrator's Office for the county in which she resided.
