Who Is Entitled to Copies of the Will

In the state of New York, who is entitled to copies of one's will? For examples, if one's children are not beneficiaries in a will, are they still entitled to copies of that will? Thank you.

A named beneficiary is entitled to a cvopy after it is probated, to be sent by the executor or the attorney for the estate. Anyone can get a copy from the Surrogate's office where it was probated, unless, for some reason, it is ordered to be sealed, for a nominal photocopy fee. You can go to the Surrogate's office and read it for free.

Although children not named as beneficiaries in a Will may not legally be entitled to a copy, it is required that each heir at law receive a notice of probate. Generally the attorney for the executor will send a request for waiver form to the heirs. Generally, a phone call to the attorney will result in a copy of the Will being provided.
