Legal Question in Wills and Trusts in New York

Estate Checking account

I am co-executor of my Dad's estate. One of my siblings has brought litigation against the Estate and it is pending. My question is can I still pay the bills for the Estate from the checking account while this is going on. There is tax prep bills for the income tax and checks that were written prior to the filing of the lawsuit that were not received by the payor that need to be re-issued. Thank you for your time.

Since you do not describe the nature of the litigation, this is difficult to answer, as he may be asking that you be removed as Executor? Since there is litigation pending, it should be simple to ask instructions of the Court as to what you can and cannot do while the litigation moves along. If the bills relate to protection and preservation of estate assets the Court will probably permit them to be paid while asnd until it renders a decision.
