Legal Question in Wills and Trusts in New York

Estate

My sister to whom was single/divorced and from NY, recently went on vacation, and while on vacation was seriously injured, and died. I live in TN, and she had no will, and I would like to know how I go about to set up to be over her Estate to close any & all accounts, etc. that she may have had, after we have received her death certificate, and can I do it from Tn?

You do not say if you have living parents? NY intestacy laws (how to handle and who is entitled to receive an estate of someone who died without a Will) are available on the Internet at any Surrogate's Office, but usually give parents preference over a sibling. The procedure for Administration, although simple, might require the assistance of a local attorney. You can call the Surrogate in the County where your sister resided and the personnel with be helpful.

Under the law of intestacy, her parents would be first in line to administer your sister's estate. If she died unmarried, without children and her parents died, then you could be appointed administrator in the Surrogate's Court. Once appointed, you would have the authority to collect her assets and otherwise administer her estate. Here is a website with more information. www.nycprobate.com
