Executive Passed Away

A second cousin passed away in March 2004. Instructions for her funeral arrangements with my name on it was found by a detective along with a hand written unwitnessed will naming me as executrix and also giving me the power of attorney. I buried her according to her wishes. So far only one very old offical will (through an attorney) was found. The executive named on this will passed away years ago. I had a lawyer who wasn't very knowledgable or helpful. He gave this matter to probate court in Queens.What happens next? Does the court handle the whole estate or do they appoint an administrator? If they do, how can I apply? Also, besides two first cousins and several second cousins there are no other living relatives. Thank you for your time.

If the handwritten document was dated, and the date was after the "official will", the later document (handwritten one) can be submitted for probate as a "holgraphic" (entirely handwritten) Will. This is important as the probate rules are different from those of conventional Wills. The earlier document (presuming the handwritten one was dated) would require an administration which could be more costly than using the handwritten Will, depending upon what the handwritten document says. In an administration, where the named executor has died before the maker of the Will, and no successors are named, the closest living relative is entitled to the appointment. If you are not the closest living relative, those closer in relationship would have to apply for appointment or renounce in favor of you.
