Legal Question in Wills and Trusts in New York
Executor of a will
After what period of time can an executor of a will be replaced for not executing a will. The Executor is not one of the two named beneficiaries. Hi doesn't return our calls or emails. Occasionally when he answers the phone, he says he's working on it. It's now been six months to execute a very simple will.

Re: Executor of a will
The beneficiaries or next of kin may petition the Court to name them executor, instead (technically called administrator d.b.n.). This will either spur the named Executor into action, or if he does not appear, you can proceed without him.
