what to expect with will
my wifes grandmother died ,gonna be 2 years in nov.her brother just put house in probate .we live in the house and i wanna know whats gonna happen now..didn;t he wait to long?how are we gonna divide the house and stocks she left?i think he made a bad mistake waitin so long.i'am totally confused on this..are we gonna have to pay penalty's??i never been through this before and don't think the brother is handling the situation right...

NY probate laws are very slow to comply with. This could account for the delay. You do not say what the Will provided should happen to the house on her death. The Will controls and the executor appointed has to follow the Will's dictates. I cannot comment without seeing a copy of the Will. If there is no Will, the matter gets more complicated, as intestacy (dying without a Will) laws control and the results might be different. More information is needed to give you an answer.
