Expenses

I live in california and must travel to ny to

divide my sister's property. Will her bank

account money cover my expenses?

I.E.Motels, airfare, car rental etc

If you are the Executor/Executrix of your sister's estate you are entitled to statutory commissions on the amount you collect and disburse (approximately 3% +/-. In addition, if the heirs do not challenge your accounting, you may be entitled to reasonable expenses.

If you are the Executor of your sister's estate, or the Administrator (if she didn't have a Will), you are entitled to Commissions of about 4% of the size of her estate. Generally, travel expenses are not recoverable unless none of the heirs object. You may be able to hire a local attorney to do the legwork, and just mail the papers in to him or her. Ask your attorney for a referral, or go to the National Academy of Elder Law Attorneys web site, www.naela.com.
