Legal Question in Wills and Trusts in New York
My father died in early Dec 09. The will and all related papers were provided to the attorney at the end of Dec 09 as well as current addresses for all the beneficiaries. There are only cash assets since everything else was sold before his death and no debt. To date there has been no action by the attorney to probate the will. Is this reasonable? I am getting impatient because I see no action on, what I believe, is a very straight-forward will. There are only 2 bills to pay; the funeral and a small medical expense. The funeral home has been calling me to see when they will receive payment as well as the beneficiaries of the will. As the executor I do feel a sense of responsibility to get things moving. I am calling for an appointment today to see what the problem is. What is the typical time frame to settle such a simple will? Am I being fair to the attorney?

If nothing was done, then I believe it is a little long. Call the attorney and ask why the delay.
