Legal Question in Wills and Trusts in New York
My father died in 1985 and in his will he left everything to his three children. One piece of property never had the ownership transfered, my brother was the Exec. of the will. I thought he had taken care of everything, but recently I learned this property was never transfered... I had paid both my brothers for their shares of the property, and trusted that the Exec. took care of everything. He has all our important papers in his care...
Now I find that this was never taken care of. How do I get the property put in my name? My one brother has died, so has his wife, they had no children.

You must record deeds showing each step (you father's estate to the three of you; then from the three of you to you only). The new deed should be signed by your brother as the executor of your father's estate, and by each of the three children. For the brother who has died with no wife or kids, you must get appointed as his Executor of his estate and sign on his behalf. Feel free to contact my office for a brief complimentary consulatation.
