Legal Question in Wills and Trusts in New York

My father owns his house. His will states his estate will be divided between his children. One of his sons lives in the house with my father. Does he have any rights to the house, over what is in the will?

Only if his name is on the deed with your father, either as a joint tenant or as a tenant-in-common.

I agree with Arnold, although he may claim that he has paid bills for the house that were not reimbursed, and/or that he has paid bills for youe Dad that entitle him to some preferential treatment, or even as Dad's caretaker that he might seek compensation for, So these potential problems should be covered somehow, in writing, if necessary.
