my father passed away

My father lives in New York and he passed away. He own an apartment building. If he does not have a will, does my stepmother get the building or does it go to his kids?

Under New York law, when a person dies without a will and is survived by a wife and children, his property is divided as follows:

$50,000 off the top to the wife,

1/2 of the remainder to the wife,

the other 1/2 divided equally among the children.
