How long do you have to file a will after a person dies in New York State?

There is no deadline or statute of limitation. File as soon as possible. If it's been a long time, the Surrogate's court may require a written explanation.

ANY TIME AFTER 2 WEEKS FOLLOWING THE DATE OF DEATH. THERE IS NO LIMTATION PERIOD ON WHEN IT CAN BE FILED, BUT THE LONGER YOU DELAY MAY REQUIRE THAT YOU EXPLAIN WHY YOU WAITED SO LONG.
