Legal Question in Wills and Trusts in New York

Where do I find a Prenuptial Agreement?

I believe that my Mother and Stepfather signed a prenuptial agreement in June or July of 1958 in Otsego or Delaware Counties. The lawyer has since passed away. This is important to the current probate of a will. How do I find same?

It would most likely be in their possessions, is there a safety deposit box where it might have been kept?

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.

While I agree with Steve, if you cannot find it among any papers of the deceased, try to find out who may have the files of the deceased attorney and contact them to see if they still have the file. Usually, but not always, someone takes over files when an attorney passes away. You may also try calling the deceased attorney's family to see if they have the files or know who might have them.
