Legal Question in Wills and Trusts in New York
my girlfriend of 10 years died two years ago. She had no will, and I just received a check from the hospital she was in this week for overpayment. It was made out to estate of her name, at my address. May I cash this check. Thank You

No! It belongs to her estate and you have no authority to do anything with it. Someone has to apply to the Surrogate to be Administrator of her estate and that person then has the power and responsibility to deal with the check.
