Legal Question in Wills and Trusts in New York

My grandmother's will

my grandmother passed away a little over a month ago. My mom passed as well. The money that my mom was supposed to get was to be given to me. I have not been notified by my aunt. Can she keep my portion?

Re: My grandmother's will

Several things. I have not seen the Will, but typically if a named beneficiary predeceases the Will maker, what that person receives goes to his/her children. Occasionally, it does not pass to the next generation, but is redistributed among those who have survivved. The Will would specify what happens. Also, a month is a short time for anything to happen, although you should have at least been notified and provided a copy of the Will. If not, you can get a copy from the Surrogate, for a small photocopying fee. If you are entitled to Mom's share, you have rights and should get an accounting. Probate administration could take some time, especially if death taxes are involved, so do not anticipate getting anything quickly.
