Legal Question in Wills and Trusts in New York

Hi,

I have a question concerning my living situation. I live in an apartment in Astoria, NY with 3 other people. We have had many issues concerning the apartment and it's safety, such as; requests to not flush toilet paper becuase of plumbing issues and to throw it away instead. Also we have numerous outlets that are not working currently. Unfortunately this is in NY and with the standard of living you can get away with almost anything. No one in this apartment signed a lease and we are allowed to move out and in freely. I am wondering if this apartment is not up to standard and if we have not signed a lease, do we have any flexibility of a lawsuit or legal action?

Without a written lease this probably would be considered a month-to-month arrangement, even if only oral. Notwithstanding the lease status, there is a presumption of habitability that might be enforced in appropriate litigation.
