Legal Question in Wills and Trusts in New York
I hired a lawyer to handle my dad estate. I dad daughter was finally given testimentary papers to
close up the account, I had hired a lawyer, but being my dad executrixx now, no longer can afford
paying this 350.00 per hr, but my lawyer got me the testimentary papers. Now the estate is only a
2 family house, 369,000.....and a parcel of land in NC. My 2 sibblings will continue to reside in the
home. Dad gave me a lifetime in the 2nd floor of the 2 family house.
My problem is my dad deed to the house was stolen 5yrs ago, I live in brooklyn ny , where do I go
to get copy of the deed , and how do a get a new deed to record at the court.
Also I need a duplicate deed to parcel of land in nc, which is recorded in NY, even tho the land is in NC.
Dad taxes have been paid every year since his passing, being the executrixx, I beleive I can begin
closing dad estate. Dad has no assets, only the house, and the parcel of land.
But where in Brooklyn, NY do a go for a duplicate copy of the the deed to his house, and how to
get the deed changed over to the new owners ? and re record the new deed.
Basically...there's 2 things I have to do as the executrixx, for I executrixx, have no more money to
apy out to any lawwyer...Ive paid out of my pocket about 13,000. The house is in Brooklyn, NY

A. Mr. Slater is wrong in his answer - probably because he is from Florida. Deeds are now electronically filed in NYC. Go to: http://a836-acris.nyc.gov/Scripts/Coverpage.dll/index. From that page you can conduct a search and download the deed.
To file a new deed is not as easy. You must prepare the deed, have the document signed by the owner of the property, and electronically file the deed with the Kings County Clerk.

A. If the land is in NC, it would be recorded in the county in NC, not in NY.
