Legal Question in Wills and Trusts in New York

House Sale

My sister who is the administrator of my sister's estate has limited powers meaning she cannot sell the house without the court's permission yet she is telling me she has sold the house and I will have to move by closing. I have lived in the house with my sister for eight years and also paid rent even now and I am interested in buying the house, but my sister is making it very difficult for me to purchase the house. Can I challenge her selling the house without the court's permission?

Re: House Sale

Usually, the Administrator of an estate may not sell real property without an order from the Surrogate's Court. Your sister may be acting without the proper authority. I suggest that you retain an attorney to look into this matter for you. You may contact me, if you wish.
