Legal Question in Wills and Trusts in New York

My husband had an unmarried, childless uncle who died in 1944, Manhatten state hospital, Wards Island. He had no will, and no estate, and had spent the 10 months prior to death in the state hospital. He was not New York resident. The body was shipped home for burial and that was the end of the story until I wanted to find out about his death for family health history. Death cert states of natural causes, but not what causes. I requested further info but was told only patient or administrator of estate could get medical records.

My question is , could my husband file to be administrator at this late date? What might this cost?

Yes, your husband could petition to be Administrator of his uncle's estate (the time lapese doesn't matter). The cost depends on many factors, such as the complexity of the uncle's family tree. If not too complex, it won't be too costly.
