Legal Question in Wills and Trusts in New York
My husbands deceased aunt's estate is in the process of Probate(not sure if that's the correct term). Aunt's spouse and siblings are all deceased. The nieces and nephews were all sent letters regarding consent to probate. My husband signed a waiver. Today we rec'd another letter from the atty. that they contacted the court for a form indicating my husband was appointed as voluntary administrator of his father's estate (who was brother to the aunt). In any case, my husband has changed his mind and does not want to waive his consent. (He originally wanted the money to go to his cousin, but she is now deceased). How can he rescind?
