Legal Question in Wills and Trusts in New York

My husband's ex mother in law died..predeceased by her daughter (his exwife) which their marriage resulted in 1 child ..a will was left with money for the child but nothing about the real estate ..my husband and his sister both received and affidavit of heirship form to fill out.why?

The child, as closest relative may also be entitle to the residual estate.The minor child must have a guardian appointed to receive his share. The attorney is looking for information to submit to the court.
