Legal Question in Wills and Trusts in New York

In-trust on bank book

My name is in-trust on my father's saving bank book. He passed away and I was giving the money from his saving account, but because my name was not on the checking, what document do I need to receive the saving account.

Re: In-trust on bank book

I'm sorry about your loss, if your name was not on the checking account as survivor. The funds in the account become part of your father's estate and need to go through probate or administration depending on whether or not your father had a will.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.

An in trust account goes to you at the death of the owner of the account. The bank will most likely accept a raised seal death certificate.
