Legal Question in Wills and Trusts in New York

Lost Deed to land

Dad passed, I only have a copy of the deed to 1 acrea of

land in North carolina. I'm the executrix of my dad will, In dad will he left me, his oldest daughter the 1 acrea of land. I got in touch with court in north carolina, who sent me a copy of the deed. Now I want the deed changed into my

name. On the copy of the deed my mother and father name is

on the deed. Mother passed, in 1977, now dad is gone.

My question can I hire a lawyer here in new york, to get the

deed transfer over to my name, even tho it's a duplicate copy of the deed. The land is in north carolina, and in dad

will it stated that I, his biological daughter gets the parcel of land in north carolina. The original deed was lost

but they mailed me a copy of the deed. Will the lawyer in

new york, get in touch with north carolina and have this deed put in my name, like dad wanted, I don't know how to go

aabout it.

Thanks

Janet

Re: Lost Deed to land

You need a NC attorney. You must file your NY appointment as executrix with the probate office in NC where the property is located, in what is called Ancillary Probate (recording your NY appointment in NC). You will probably need an original death certificate for your mom also, as she is named in the deed and has predeceased your dad, as part of this. Once qualified in NC you merely prepare an Executor's Deed for the NC property and record it in NC. Any NC attorney familiar with probate matters can help you. You can get recommendations from the local NC Bar Association.
