making changes to a will

I would like to change a suggest in my will which states that when I die and if my son does not survive me, the money should not go to his wife but back into the estate.

I suggest that, by Codicil or by a new Will, you make the change to say something like this: "If, at the time of my death, my son ______ has predeceased me, his share of my estate shall pass to his issue(this means children, grandchildren), if any, in equal shares, per stirpes, and if there be none surviving me, his share shall go to ______." This should cover what you desire.

While technically you can make a codicil that will legally change your will, I suggest that you draft a new will revoking your previous will and state your intentions from scratch. That way there will be no ambiguities.

It would be best to draft a new will with a lawyer stating exactly want you want.
