Legal Question in Wills and Trusts in New York

HE has a will which covers his property and savings for his children., We would like to get married.Don't want him to change his will. I am only looking for security if he dies before me, which would be his pension and social security Do I need a pre nuptial or what . He is 85 I am 75. We have been living together for 2 years in his house. Thank you

If you get married, you will be entitled to a spousal election, which means you are entitled to 1/3 of his estate regardless of what his will says or how his beneficiary designations are listed.
