Legal Question in Wills and Trusts in New York
The mother of a deceased widowed man with no children technically would be the next of kin. Regarding a will , which he had , but she was not named in . Being next of kin can she contest the will. Does the lawyer probating the will need the mother to sign a waiver of her rights in order to probate the will?

she may contest the will. If she received notice from the Surrogates Court of will probate then she should not delay and hire an attorney to contest the will.
