Legal Question in Wills and Trusts in New York

My mother died 21 years ago and now Dad has died without a will. He has a house on the lake and 6 living children. I am the only one of the 6 who would like to sell the house. How do I go about getting out of this partnership with 5 others?

See if the other five want to buy your share. If they don't, you can go into court to compel a sale. It is called a partition action.

In examining this response, please note that we are not entering into an attorney/client relationship, that this is to be taken as informative, and not as legal advice, that it is always best to speak to a lawyer in your area and/or in the area where the transaction and/or events occurred, and that my answer is necessarily limited by the fact that I have not seen the documentation or had an opportunity to go over the matters with you in detail.

I AGREE - If they do not want to purchase your interest, a suit for Partition may be required.
