Legal Question in Wills and Trusts in New York
My mother is very very ill and elderly. She has bonds in the amounts of $16,000 that will more than likely have to be cashed in soon in the event she passes. She is too ill to sign any documentation needed to cash in the bonds or transfer them to my brother and I.
There is a will however I have no idea how things are designated. If these bonds are not mentioned in the will or "other assets" are not specifically mentioned, will these bonds be split between my brother and I as her only heirs by matter of law?

The bonds in her name are part of her estate and will be distributed per her will.
I agree with David. Even if not specifically mentioned, the Will probably specifies that her estate is distributable to your brother and you. If so, the bonds are included.
