Legal Question in Wills and Trusts in New York

My mother passed away in August. The only property she had was a small fixer-upper house where my brother is living.. How long do we have before we have to have her will probated? I'm concerned there could be problems with state and local property taxes if we don't probate soon.

f the house is the only asset in her estate, you and your brother, (provided you are her sole heirs) can deed the house to yourselves.

Probate would be necessary if their are other assets solely in your mother's name.
