Legal Question in Wills and Trusts in New York

Mother's will left everything to common law spouse of 10 years. Me and my sister from first marriage were left out of will. Shortly after death he asked us to sign off on will. He would take care of us. We did so and it's five years later. Do we have any grounds to sue?
