Power of Attorney
Can a Power of Attorney legally
revise and/or sign a will? Also, does
the Power of Attorney have the right
to change the beneficiaries of a life
insurance policy? Is it true that a
notary public must be present as a
witness of signature at the time the
power of attorney form is signed?

Re: Power of Attorney
1. A Power of Attorney form in NYS must be signed before a notary public;
2. The agent may be able to change beneficiaries of a life insurance policy depending on the powers granted in the POA document;
3. An agent cannot sign or revise a Will utilizing a POA.
