Legal Question in Wills and Trusts in New York

power of attorney

Can i prepare a power of attorney for my parents while they are still mentally capable?

do I need to prepare one for each state that we may be in or is one form good for all states?

(my parent currently lives in NY but we plan to move to VA in a couple months)

what type of power of attorney is best so I can act on all matters for my parent?

Re: power of attorney

If you're moving to Virginia the power of attorney form should be one appropriate for use in the Commonwealth. (You can probably purchase and download the form from the lawguru website.)

You can certainly prepare the form but if there are a lot of issues to cover which may require more than one POA, you should consult with an attorney appropriately knowledgeable in this particular area of law to insure the correctness and accuracy of the document(s).
