Legal Question in Wills and Trusts in New York

Power of Attorney in another state

If the Power of Attorney has been executed in Nebraska will I be able to, for example, handle matters in New York banks where the accounts still reside?

Re: Power of Attorney in another state

Yes, if a Power of Attorney is properly drawn in one state it will be given full authority in New York State. Hopefully you have an Original document and not just a copy. Some bank employes may initially turn you away bceause the document is unfamiliar to them. You will probably have to speak to a manager and then he/she will probably have to call their legal department.

Does the person who signed the POA reside in NYS? Is he or she still competent? If so, I would suggest having a NYS POA signed ASAP.

If properly notarized, it should be good anywhere.
