Legal Question in Wills and Trusts in New York

probate

I would like to download a last will and testatment form from another website. However, I'm not quite sure what I need to do after I write the will, i.e., should I have an attorney look it over and do I need to submit it to a probate court.

It is a simple will, wherein I only own a condo and shares of stock.

A will is not submitted to probate until the testator dies. There are some very specific requirements for a will without which the will can be rendered invalid. A "simple" will can be done fairly inexpensively with legal expertise. I would encourage you to plan and draft your will with the help of an attorney.

If you would like, I have a form of simple Will that can be used for NY residents, which I can assist you in preparing to conform to the NY requirements and my fee is $75.00 for all aspects (submission, review and verification of NY compliance). Once properly signed, witnessed and notarized, it is retained until your demise, then submitted to the Surrogate for probate. This means that no submission is required now. This allows you to make changes in the future, although my form can be utilized if anything changes between now and your demise. Contact me if there is interest. Be somewhat wary of off-the-shelf forms or internet forms not personalized to your situation, as they might not be in complaince with your situation or local laws.
