Legal Question in Wills and Trusts in New York

probate and estae

My father's will states coexecutors. My sister and I. We do not agree on anything at this point. Legally can we each hire our own lawyers which will be paid for by the estate?

Yes. You are each entitled to retain your own attorneys. Resonable legals fees should be paid by the estate.

While each Executor can retain independent cousel, the costs may be excessive to the estate. I suggest that the co-Executors narrow their areas of disagreement and retain someone to mediate them. This might be less costly. You have not described the areas of disagreement, or how they might impact the estate. Perhaps raising this question here might get you an answer you can agree upon.
