Legal Question in Wills and Trusts in New York

probate

Our father's estate is in probate. His will left 2 homes to my sister and 1 one to me. We are fine with this. We have just recieved our letter of testimentary. At this point we are wondering if the house deeds can be put in our names or do we have to wait till the end of probate to have new deeds generated.

Mike is correct that the new Deeds can be done at any time, and you need not wait until probate is completed. The new Deeds should follow what the Will provides as to who are the respective owners. You do not indicate the value of Dad's estate and there may be death taxes due to the State, if the total value of the estate exceeds $1,000,000. Contact me directly if you need more information.
