Legal Question in Wills and Trusts in New York
probate in nyc
A house was left to 3 children (no will). They are all tenants in common. One of them died. The estate was never settled. Does it have to go to probate because of this death of one of the owners? Please advise.

The answer depends on what the remaining two siblings and the family of the deceased sibling want to do with the house. If all family members are in agreement, it's possible to leave title as is until it later becomes necessary to change the deed.
