Legal Question in Wills and Trusts in New York
Probate
If 2 people are named co-executors in a will, are there any conditions under which both (or either) executor must probate the will within a certain time limit? If so, what are those conditions given that all bills of the estate are still being payed.

I agree with Todd, that while the probate code does not specify a mandatory time to probate a Will, someone could contest the effect of their delay. You do not say how or who is paying the bills. This could have ramifications down the road and should be done by the Executors. Plus, they have a duty to administer the estate for the benefit of those named in the Will and their delay in assuming this responsibility could expose them to some liability if there are losses in value of assets or some other loss arising from their delay in acting.
