Legal Question in Wills and Trusts in New York

Probate Process in NY

I am the executor of my deceased relatives estate - he died with a simple will & we hired an atty, there are 2 beneficiaries. i was named prelim executor - that was in January. All assets were moved to trust accounts. The atty finally filed papers in surrogate court in NY recently. There are no others contesting. How much longer beore i am named official Executor and can make distribution and take my fee? How much longer before probate is generally completed. one of the beneficiaries has a real financial need.

Re: Probate Process in NY

It depends on whether the attorney filed the proper documents, whether anyone contested probate, and the Court's docket.

It is my experience that letters are generally issued by the Court within 4 weeks from date of filing.
