Legal Question in Wills and Trusts in New York

Recovering Fixed deposits in New York State

I live in Canada. My aunt who lives in Jamaica recently passed away. Her closest remaining relative is her brother my father who also resides in Jamaica. He is unable to travel to New York. My aunt left no will. She has two fixed deposit accounts in New York banks. She was a joint holder of the deposits. The other named holder of the accounts is also deceased and died intestate in Jamaica in 2000. The named beneficiary also passed away in 2002. My aunt was senile for two years before she passed. My father was granted Power of Attorney and Guardianship of my aunt in 2002. What would be the process to recover the money in the bank accounts

It is not clear from your question whether the assets are located in New York. However, based on the information you provided, there is a procedure in New York to distribute assets to next of kin where the deceased died intestate.

Your aunt's funds can be recovered; an appropriate ancillary probate proceeding willl need to be opened and a person will need to be court appointed to administer her estate. Your father's power of attorney and guardinaship status died with your aunt. Please e-mail or call igf you have additional questions.
