Legal Question in Wills and Trusts in New York
Removing an Administator NYC
We live in New York City and both of our parents passed without a will. We made our eldest sister the Administrator of my Mother's estate of which since she has made a mess of and has not performed her duties.
How do you remove the administrator?

You would have to petition the Surrogate's to remove the sister as an administrator. The petition must give factual reasons why the sister breached her fiduciary duty toward the estate.
Feel free to telephone my office if you need a better explanation of the procedure involved.
Mike.
