Legal Question in Wills and Trusts in New York
Rights of Beneficiaries in NY
My grandfather died in January 2007. His only assets were a bank account and stock certificates to be divided equally among 4 children, no property. My aunt is the executor. My mother has not been able to get any info from my aunt regarding the status of the will in probate. Is there any other way she can find out what is going on? Are there laws in NY regarding an executor carrying out the job in a timely fashion?

Call the Surrogate in the County where your grandfather was living when he died. They will tell you if a Will was probated, who was appointed and who is the attorney for the estate. For a small fee they will also send you a photocopy of the Will. If someone has been appointed, you should have heard something by now. Hopefully, nothing inappropraie has been done with the estate assets.
