Setting up a will

My husband and I are setting up a will. We have 2 children 23 and 17.

Would like to leave all our assets to both of them evenly. Would like our 23 years to handle everything until our younger son is 21 years old if need be. Also what are the requirement to be our will valid in terms of signatures. Can we just sign a will or do we have to have a lawyer present?

You should retain an attorney to draft and supervise the will execution.

Wills must be very carefully drafted and signed. Mishaps are very costly and can interfere with the probate process.

The legal cost of a Will is nominal (usually $ 250 or so) compared to the Court costs to interpret and correct errors.

A simple will, such as you describe, should cost about $175-200 to draft and execute.

It would eliminate many problems which might arise.
