Legal Question in Wills and Trusts in New York

we are trying to settle my grandmothers estate and there is some money that is being divided up amoung the family. We need a notary. The person that is going to be the notary is related to the family. Is this legal?

If the notary is not receiving either money from the will or some sort of benefit, the answer is yes.
