Legal Question in Wills and Trusts in New York
My sister in law recently passed away. She didn't have anything so my 2 brother in laws and myself paid for her funeral. Right before she passed she had a law suit settle which she was suppose to recieve monies that would have covered the cost of the Burial. When our spouses called the attorney to find out the next step he said that because her father was still alive he was entitled to the settlement. She was 50 years old and estranged from her father. She hasn't spoken to him in over 25 years. The lawyer won't discuss anything with us because he said her father is now the recipient of her settlement. Is there anything we can do to stop this. Or at least get back the money we laid out for the funeral?
