Small Estate affidavit
I need an affidavit for an estate worth $100,000 or more in securities in New York state. Is there such a form, and do I need a lawyer to proceed?

YOU DO NOT SAY HOW THE SECURITIES WERE REGISTERED (JOINTLY WITH SOMEONE OR INDIVIDUALLY). IF INDIVIDUALLY, THE FORM YOU NEED (AFFIDAVIT OF DOMICILE) NEEDS TO BE SIGNED BY THE EXECUTOR OR ADMINISTRATOR. IF YOU ARE A JOINT OWNER, YOU MAY BE ABLE TO SIGN THIS FORM YOURSELF. MORE INFORMATION IS NEEDED TO PROVIDE A BETTER RESPONSE.

Your question was sent to me by LawGuru, being an atorney in Arizona. The issue is whether the decedent was a resident of Arizona or New York. If New York, an attorney in that area can help you. More information is needed. Joint tenancy account? In the name of a trust? Usually there is a beneficiary on the account and the institution has their own forms if there is a beneficiary.
